What’s in the News for Intoxicating THC? Implications of THC laws on the Texas Hemp Market!

What's in the News for Intoxicating THC?

After the acceptance of the 2018 Federal Farm Bill, Texas saw a surge in hemp consumption. The lawmakers in Texas accepted the bill as they thought it would give the Texas agriculture sector a much-needed boost. They legalized hemp farming and lifted the ban on the sale of hemp products. Due to legalization of hemp products and its derivatives, there are now over 7,700 licensed hemp dispensers in Texas alone. These registered retailers have created jobs for up to 50,000 Texans. Therefore, the hemp industry is thriving in Texas.

Recently, Texan lawmakers are moving towards a blanket ban on intoxicating hemp products, with Lieutenant Governor of Texas Mr. Dan Patrick taking the charge. The lawmakers aim to stop the production of intoxicating hemp products by dodgy retailers. These retailers are using the loophole present in the 2018 Farm Bill to put harmful and intoxicating substances by using legal industrial hemp. The Texas Governor has recently reported that banning all such forms of hemp products with high levels of THC is one of his top property legislative goals.

Let’s take a closer look at the background of such a drastic legal charge and what it could mean for the Texas hemp market. We will also discuss why our products at Colorado Breeders Depot are an exemption to this ban.

2018 Federal Farm Bill and Its Exploitation:

The retaliation from Texas Governor Patrick against hemp products came as a response to the unregulated production and distribution of intoxicating hemp products. These hemp products tend to contain high levels of Tetrahydrocannabinol (THC), which are know to impair the users. To increase sales of such products, retailers also sell knock-off versions of famous snacks and beverages that children mistakenly use.

“Dangerously, retailers exploited the agriculture law to sell life-threatening, unregulated forms of THC to the public and made them easily accessible. These stores not only sold to adults, but they targeted Texas children and exposed them to dangerous levels of THC”, said Patrick in a recent statement. Gov. Patrick announced his push for a complete ban on neurotic and intoxicating products.

The state of Texas hasn’t allowed the broad use of marijuana products. This allowed many illicit hemp producers and growers an open market to target.

The Need for a Blanket Ban:

Once hemp was legalized in Texas, the production and distribution of synthetic hemp products with intoxicating compounds skyrocketed. Due to limited countermeasures set in place by the Texas legislature, many breeders and growers exploited the 2018 Farm Bill and found loopholes. Many Texas critics advised against the production of cush products due to a lack of proper testing, clear regulation, and age restrictions. Reports have shown that many products on the Texan hemp market are in clear violation of the 2018 Farm Bill that clearly states that hemp products on sale must contain less than 0.3% THC content. These products contain a dangerously concerning high amount of THC percentage which is around 7% to 78%.

Consuming hemp products with high THC content can lead to vomiting, headaches, unconsciousness, dizziness and other ailments. Not only are these products intoxicating but they can even cause hemp poisoning.

Counter Measures to Contain Intoxicating Products:

The need for such drastic countermeasures came due to a public demand. The Lt. Gov. Dan Patrick’s recent statement addressed this issue. He stated, “Since 2023, thousands of stores selling hazardous THC products have popped up in communities across the state, and many sell products, including beverages, that have three to four times the THC content which might be found in marijuana purchased from a drug dealer”.

To counter the production and sale of high THC content products, the government of Texas will implement a complete ban on such products under Senate Bill 3. It will officially carry by Sen. Charles Perry. If the bill receives bipartisan support in the Senate, it will become the law that will immediately ban all forms of THC content and marijuana.

What is the Future of Hemp in Texas?

The hemp market in Texas is too big to simply banned. Previous attempts to fully ban the production and distribution of hemp products have been countered and stopped by key stakeholders. However, the ball is now in Lt. Gov. Dan Patrick’s’ court. Instead of administrating a full blanket ban on hemp products, the government of Texas could implement strict regulation, third-party state sponsored lab testing and age verification to stop the sale of high THC and intoxicating compound production. Not only will this deter retailers from producing intoxicating products, but it will also keep consumers safe from such issues.
